Website Terms of Use — Evergreen v1.0

Effective September 8, 2026

1. Acceptance and Scope

These Website Terms of Use govern access to and use of EPA's public website and EPA-controlled online content. They do not replace separate agreements governing paid EPA instructional services.

2. About EPA

EPA provides educational services and resources, including virtual literacy, reading, writing, academic-support, and related educational programming. Public website content is intended primarily for informational and educational purposes.

3. Educational Information - Not Clinical Advice

Website information should not be interpreted as medical, psychological, speech-language, special-education, legal, or clinical advice or diagnosis, including diagnosis of dyslexia, ADHD, learning disabilities, or other conditions.

4. No Guarantee of Educational Outcomes

EPA does not guarantee a particular score increase, grade-level advancement, school promotion, mastery within a particular period, admission outcome, standardized-test result, diagnosis-related outcome, or other specific educational result.

5. Enrollment and Availability

Submission of an inquiry, consultation request, enrollment form, email, or diagnostic request does not itself guarantee admission, a particular placement, instructor availability, or a specific schedule. Final small-group placement follows EPA's approved diagnostic and teacher-review process.

6. Tuition and Payment Information

Website tuition information should correspond to EPA's current controlled Tuition & Service Rate Sheet. Payments, recurring tuition, withdrawal, cancellation, credits, and refunds are governed by the applicable enrollment documents rather than these Website Terms alone.

7. Intellectual Property

Unless otherwise stated, EPA owns or controls rights to its original website text, graphics, instructional frameworks, educational materials, logos, branding, designs, program names, downloadable resources, curriculum structures, written guidance, multimedia, and other proprietary content. Third-party materials remain owned by their respective rights holders.

8. Permitted Personal Use

Visitors may access public EPA content for ordinary personal, family, or informational use. Downloadable resources remain subject to any stated license or use conditions. Unless EPA provides permission, users may not reproduce or redistribute EPA proprietary content for commercial purposes.

9. Prohibited Uses

Unauthorized redistribution or sale of EPA proprietary or paid materials

Removal of ownership, copyright, trademark, or attribution notices

Misrepresentation of affiliation, endorsement, employment, or partnership

Unauthorized access to restricted systems or accounts

Interference with website operation or security

Malicious code, unlawful use, or infringement of EPA or third-party rights

Automated scraping or harvesting in violation of applicable law or EPA's rights

10. AI Training and Automated Extraction

Except where expressly permitted by EPA or applicable law, EPA does not authorize systematic extraction of proprietary instructional content for the purpose of training, fine-tuning, developing, or materially improving a commercial artificial-intelligence model or competing educational content system. This restriction binds anyone who accepts these Terms and does not by itself give EPA rights against a person who has not.

11. Trademarks and Brand Identity

Website access does not grant ownership of or unrestricted rights to EPA names, logos, program identifiers, taglines, or other distinctive brand elements.

12. Third-Party Platforms and Links

EPA may link to or use third-party websites, payment processors, scheduling tools, educational platforms, social networks, or service providers. Their own terms, privacy practices, and account requirements may apply.

13. Privacy

EPA's handling of personal information is addressed through the applicable EPA Privacy Policy. Separate consent procedures apply to student recordings and public student media. Information about children under 13 is covered by EPA's separate children's privacy notice.

14. Accounts and Credentials

Users are responsible for reasonably protecting usernames, passwords, access links, and authentication information. Users may not access another family's, student's, instructor's, or staff member's account without authorization.

15. Minors

Contractual enrollment, payment authorization, consent, and administrative account decisions for minor students should be completed by a parent, guardian, or authorized adult when required.

16. Testimonials and Examples

Testimonials reflect individual experiences and do not guarantee that another student will achieve the same result. Student work or media may be used only under the applicable permission.

17. Publicly Submitted Information

Visitors must not submit sensitive student information through general public contact fields unless EPA specifically requests the information through an approved secure process. EPA requests that information through a secure intake instead.

18. Website Accuracy and Availability

EPA aims to keep public information current but may correct, update, remove, or reorganize content. EPA does not guarantee uninterrupted website or third-party service availability.

19. Accessibility

EPA aims to provide digital information and educational materials in ways that support accessibility and inclusive use. Visitors who experience difficulty may contact EPA to request reasonable assistance or an alternative format when available.

20. Feedback

Voluntary feedback may be considered when improving EPA services, but submission of general feedback does not automatically transfer ownership of independently created intellectual property to EPA.

21. Suspension of Website Use

EPA may restrict website or system access when reasonably necessary to address unauthorized access, fraud, misuse, security threats, harassment, unlawful activity, or infringement.

22. Website Terms Do Not Modify Existing Enrollment Agreements

Nothing in these Website Terms automatically changes the terms of an existing EPA enrollment agreement. Changes affecting an enrolled family's contractual rights or obligations will be handled in accordance with the applicable agreement and law. If these Terms conflict with an enrollment agreement, the enrollment agreement controls.

23. Authorized Student/Family Access

Access links, paid instructional resources, student materials, classroom resources, and account credentials provided to an enrolled family are intended for the authorized student or family and may not be shared, resold, or distributed for unauthorized use.

24. Separate Product Licenses

Educational products purchased through a third-party marketplace or other EPA sales channel may be governed by separate product licenses, marketplace terms, or usage permissions. These Website Terms do not expand those licenses.

25. Liability, Governing Law, and Disputes

The website is provided as is. EPA is not liable for indirect or consequential losses arising from use of the website, and its total liability for any claim relating to the website is limited to $500. These limits do not apply to gross negligence or willful misconduct.

A user is responsible for losses EPA incurs because the user misused the website, redistributed EPA content without permission, or infringed another person's rights.

These Terms are governed by Texas law, and any dispute will be brought in the state or federal courts in Dallas County, Texas.

Before filing, the party raising the issue will give the other written notice and 30 days to resolve it. Either party may bring a claim in small claims court. Claims are brought individually and not as part of a class or representative action.

26. Changes to These Terms

EPA may revise these Website Terms as its website, services, technology, or legal requirements change. A website update does not automatically amend an existing family's contract where additional notice or assent is required.
